By accessing or using the Nobiru platform (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform. These Terms constitute a legally binding agreement between you and Nobiru.
Nobiru is a private, invite-only professional network designed for verified elite athletes, organizations and institutions. The Platform facilitates connections and opportunities, but does not act as an employer, agent or contractual intermediary between its users.
The Platform is available by invitation only. Athletes must have competed at an elite level (national team, international competition, or equivalent) to be eligible. Organizations must be legitimate companies or accredited universities. Nobiru reserves the right to verify eligibility and to deny or revoke access at any time, for any reason, at its sole discretion.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current and complete information and to update it as necessary. You must notify Nobiru immediately of any unauthorized use of your account.
Nobiru may grant athletes a "Verified Elite" badge based on internal criteria. This verification validates the athlete's identity and athletic career, but does not constitute an endorsement, guarantee, certification or employment recommendation by Nobiru. Nobiru assumes no responsibility for decisions made by organizations based on such verification.
You agree not to: post false, misleading or fraudulent information; harass, abuse or harm other users; attempt to gain unauthorized access to the Platform; use the Platform for unauthorized commercial purposes; scrape data using automated means; or impersonate any person or organization.
Organizations may request contact with athletes on the Platform. Contact requests are reviewed by Nobiru and must be approved by the athlete personally before any contact details are shared. Athletes retain full control over who can contact them.
All content on the Platform, including text, graphics, logos and software, is the property of Nobiru or its licensors and is protected by applicable intellectual property laws. You retain ownership of the content you submit to the Platform.
Nobiru enables supporters ("Angels") to make voluntary financial contributions — either to support a specific athlete's campaign or to support Nobiru's mission generally. All payments are processed by Stripe, Inc., a third-party payment processor, under Stripe's own terms and licenses. Nobiru does not itself hold, transmit or take custody of funds as a money transmitter; the movement of funds is performed by Stripe. Where you contribute to a specific athlete, Nobiru retains a platform fee (currently 5% of the contribution) for operating the Platform, and the remainder is directed to the athlete through Stripe's payout services once the athlete has completed the required onboarding. Payment-processing fees are disclosed at checkout and are borne by the Angel. Contributions are voluntary and are not purchases of goods or services.
You may choose to make a recurring monthly contribution. By selecting a monthly contribution and confirming payment, you authorize Nobiru (through Stripe) to charge your payment method the stated amount automatically each month until you cancel. The amount, currency and monthly frequency are displayed before you confirm, and your contribution renews automatically each month. You may cancel at any time, without penalty, at nobiru.global/manage (also linked in the footer of every page), which takes you to a secure Stripe-hosted portal where you can cancel or update your payment method. Cancellation takes effect immediately and stops all future charges. We recommend cancelling before your next monthly billing date to avoid being charged for the upcoming period.
Because contributions are voluntary and are directed to athletes or to Nobiru's mission, they are generally non-refundable. If you believe a charge was made in error, or you cancelled a recurring contribution and were charged after cancellation, contact us at hola@nobiru.global and we will review your request. Refunds, where granted, are issued to the original payment method. Nothing in this section limits any rights you may have under mandatory consumer-protection laws in your jurisdiction.
Certain features may allow a verified institution (such as a federation or club) to create a fundraising campaign on behalf of an athlete who is under 18. Where an institution does so, the institution represents and warrants that it has obtained all necessary consents from the athlete's parent(s) or legal guardian(s), that it is authorized to act on the athlete's behalf, and that it is responsible for delivering the contributed funds to the athlete in accordance with applicable law. Nobiru does not knowingly establish direct financial relationships with minors outside of this institution-mediated process, and is not responsible for the acts or omissions of institutions in fulfilling these obligations.
These Terms are drafted in English, which is the authoritative and governing version. Any translation is provided for convenience only. In the event of any conflict or inconsistency between the English version and a translation, the English version prevails.
The Platform is provided "as is" without warranties of any kind. Nobiru does not warrant that the Platform will be uninterrupted, error-free or free of harmful components.
To the maximum extent permitted by law, Nobiru shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Platform.
We may update these Terms from time to time. We will notify you of significant changes via email. Your continued use of the Platform constitutes acceptance of the updated Terms.
